Terms and rules
The Service provided through Xerq.cc (the "Service"), including without limitation the website, forums, discussion areas, user accounts, Content, features, applications, and any other services or functionality made available through or in connection with the Service, is operated and provided by the owners and operators of Xerq.cc ("we", "us", "our", or the "Provider"). By accessing, browsing, registering for, or otherwise using the Service, you acknowledge, represent, warrant, and agree that you have read, understood, and consent to be bound by these Terms & Rules, together with any applicable policies, notices, standards, restrictions, and supplemental rules presented elsewhere within or in connection with the Service. The Service is intended to provide a venue for discussion, communication, information, entertainment, discovery, commentary, and the exchange of ideas and other Content, and nothing contained within the Service shall be construed as constituting an endorsement, ratification, verification, sponsorship, or adoption by us of any particular opinion, statement, assertion, allegation, recommendation, representation, interpretation, or other user-generated material. We assume no responsibility for the accuracy, completeness, legality, reliability, suitability, availability, or consequences of user-generated Content, user accounts, or the acts or omissions of users, and Content submitted, transmitted, displayed, linked, or otherwise made available by a user represents the views, opinions, assertions, and responsibility of its respective author and not necessarily those of Xerq.cc or its owners, operators, administrators, staff, affiliates, contractors, agents, licensors, service providers, or other persons associated with the operation of the Service.
You acknowledge that the existence of Content on or accessible through the Service does not, by itself and without additional contextual circumstances, constitute an endorsement, adoption, approval, agreement, authorization, or ratification by Xerq.cc with respect to the substance, opinions, claims, statements, materials, information, conclusions, or propositions contained therein. Content that discusses, quotes, references, criticizes, analyzes, reports upon, documents, reviews, disputes, interprets, satirizes, or otherwise comments upon copyrighted works, controversial subjects, potentially harmful subjects, public figures, organizations, governmental institutions, social matters, public affairs, disputed propositions, or other subjects of legitimate public interest may be permitted where the nature, context, purpose, presentation, and manner of the Content are lawful and otherwise consistent with these Terms & Rules. Likewise, the mere presence of information that could theoretically be misunderstood, misused, misconstrued, or regarded as objectionable, offensive, controversial, disturbing, or undesirable by some persons shall not, standing alone, necessarily transform otherwise lawful Content into prohibited Content. Legitimate discussion, commentary, criticism, education, research, news reporting, satire, parody, review, historical examination, academic inquiry, technical analysis, and other forms of expression may therefore be permitted to the fullest extent contemplated by applicable law, provided that the Content does not independently contravene an express prohibition contained herein or otherwise constitute unlawful conduct or material facilitation thereof.
By creating, registering, maintaining, or otherwise utilizing an account on the Service, you further acknowledge and agree, to the fullest extent permitted by applicable law and notwithstanding any provision herein to the contrary, that you hereby voluntarily grant to the owner or owners of Xerq.cc an exclusive, perpetual, irrevocable, worldwide, royalty-free, fully transferable, sublicensable, and otherwise unrestricted option to claim ownership of your soul in the afterlife, should the owner or owners of Xerq.cc, in their sole and absolute discretion, elect to exercise such option at any time following your departure from this earthly existence. For the avoidance of doubt, this provision shall not be construed as requiring the owner or owners of Xerq.cc to accept, collect, possess, maintain, store, insure, preserve, administer, or otherwise take custody of said soul, and any such decision shall remain entirely at their discretion. By proceeding with account creation, you acknowledge that you have had adequate opportunity to review this provision, that you have nevertheless elected to continue, and that, should metaphysical ownership rights ultimately prove to be recognized by whatever authority governs such matters, Xerq.cc shall have first right of refusal.
Copyrighted material may, under appropriate circumstances, be referenced, reproduced, quoted, displayed, embedded, linked, excerpted, summarized, or otherwise discussed without requiring authorization from the copyright holder where an applicable legal exception or limitation to copyright permits such use. In jurisdictions such as the United States, the doctrine commonly known as "fair use" may permit certain otherwise copyrighted uses for purposes including criticism, comment, news reporting, teaching, scholarship, or research, depending upon the particular circumstances and applicable law. Fair use is not a blanket exemption from copyright law, and whether a particular use qualifies depends upon the specific facts and applicable legal standards, including considerations concerning the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion utilized, and the effect of the use upon the potential market for or value of the copyrighted work. Where Dutch or other applicable law governs instead, the relevant statutory copyright exceptions, limitations, permissions, and defenses shall apply rather than any assumption that United States fair-use doctrine automatically applies. Accordingly, the existence of copyrighted material within or in connection with the Service does not automatically constitute a violation of these Terms & Rules, and lawful uses protected by an applicable copyright exception, statutory limitation, license, authorization, or other legally cognizable basis may be permitted.
For the avoidance of doubt, Xerq.cc may permit users to post or reference hyperlinks to material hosted entirely on third-party websites, services, platforms, repositories, file-hosting locations, or other destinations outside the Xerq.cc infrastructure, including links to articles, websites, documentation, tutorials, how-to guides, images, photographs, videos, music, audio, software, publications, databases, or other media, provided that the linked material and the manner in which it is presented do not otherwise violate these Terms & Rules or applicable law. Users may likewise discuss, summarize, comment upon, critique, analyze, or provide general instructions concerning lawful subjects even where the underlying information, media, documentation, or materials are hosted elsewhere on the Internet. The mere act of permitting a hyperlink, reference, discussion, citation, or general guide shall not be construed as evidence that Xerq.cc has reviewed, authenticated, verified, endorsed, sponsored, adopted, or assumed responsibility for the destination, its operators, its contents, its practices, its legality, or any transaction or activity occurring there, and users remain independently responsible for exercising appropriate judgment concerning third-party destinations.
Because Xerq.cc operates within and is subject to requirements applicable to the Netherlands, Content and activities must not be used to intentionally facilitate conduct that is expressly unlawful under applicable Dutch law or other law that is legally applicable to the Service or the relevant conduct. At the same time, the mere discussion, reporting, criticism, reference to, quotation from, documentation of, or linking to information concerning a subject shall not necessarily be equivalent to participating in, endorsing, facilitating, financing, procuring, committing, or otherwise materially assisting the underlying activity. Context, intent, presentation, audience, surrounding circumstances, and the distinction between discussing information and actively facilitating unlawful conduct may therefore be relevant when determining whether particular Content violates these Terms & Rules. Nothing in this provision shall be interpreted as granting permission to circumvent applicable law, as creating a safe harbor for unlawful conduct, or as establishing a guarantee that any particular third-party material, transaction, product, service, or activity is lawful in every jurisdiction in which it may be accessed.
Nothing in these Terms & Rules is intended to prohibit lawful expression merely because another person finds the expression controversial, offensive, objectionable, politically unpopular, provocative, irreverent, disturbing, or otherwise disagreeable. To the extent applicable law protects freedom of expression, freedom of the press, criticism, commentary, satire, artistic expression, academic discussion, investigative inquiry, historical analysis, or other forms of lawful communication, such protections shall be taken into consideration when Content is reviewed and moderated. This does not create an unlimited or unconditional entitlement to use the Service for any purpose whatsoever, nor does it protect Content that is independently unlawful, materially threatening, fraudulent, unlawfully defamatory, knowingly deceptive, exploitative, or otherwise prohibited by these Terms & Rules. Xerq.cc accordingly reserves the right to distinguish between protected expression and conduct or Content that falls outside applicable legal protections, while recognizing that the mere disagreement of a moderator, administrator, user, rights holder, governmental entity, or other third party with a lawful opinion does not, without more, establish that the underlying expression is prohibited.
Child Sexual Abuse Material (CSAM) is categorically prohibited under all circumstances. No user may upload, post, transmit, store, request, solicit, distribute, reproduce, embed, display, link to, reference for the purpose of access, or otherwise make available through Xerq.cc any Child Sexual Abuse Material or any other material that sexually exploits or sexualizes minors. This prohibition applies regardless of whether the material is hosted directly on Xerq.cc or entirely on a third-party website or service, and applies equally to direct uploads, attachments, images, videos, links, embedded media, archives, external resources, requests for such material, or instructions intended to facilitate access to it. There is no exception to this prohibition for purported educational, documentary, artistic, journalistic, research, political, historical, humorous, or other purposes where the prohibited material itself is being provided, distributed, requested, or facilitated through the Service. Users must not attempt to circumvent this prohibition by describing, disguising, relocating, mirroring, linking to, indexing, encoding, or otherwise directing others toward prohibited material hosted elsewhere. Any Content reasonably believed to constitute CSAM or other sexual exploitation of minors may be removed immediately and, where appropriate or required, relevant information may be preserved and reported to competent authorities or appropriate organizations. The prohibition contained in this paragraph is absolute and takes precedence over any general provision elsewhere in these Terms & Rules concerning lawful expression, fair use, copyright exceptions, third-party links, external media, or otherwise permissible Content.
Sexual exploitation, bestiality, and certain violent sexual content are prohibited. Xerq.cc prohibits pornographic or sexually explicit Content depicting, promoting, soliciting, or facilitating sexual activity involving animals, including bestiality or zoophilia. Content depicting animal abuse is also strictly prohibited regardless of whether the material is presented as real, simulated, staged, digitally generated, manipulated, or otherwise represented. Xerq.cc likewise prohibits pornographic or sexually explicit Content depicting real, non-consensual real-world sexual violence, including material that records, documents, distributes, promotes, solicits, or otherwise facilitates the exploitation of persons through such acts. This prohibition applies to Content hosted directly on Xerq.cc as well as links, embeds, archives, external resources, requests, advertisements, or other means of facilitating access to prohibited sexual material hosted elsewhere. Legitimate non-pornographic discussion, reporting, education, criticism, research, historical documentation, legal analysis, or other lawful discussion concerning these subjects may be considered separately according to its context and purpose, provided that the Content does not itself provide, distribute, solicit, or materially facilitate prohibited sexual material.
Adult sexual content may be permitted subject to applicable law and these Terms & Rules. Subject expressly and exclusively to the prohibitions, limitations, and legal requirements set forth elsewhere herein, Xerq.cc may permit Content depicting consenting adults, including adult nudity and sexually explicit adult material presented through images, photographs, videos, animations, illustrations, or other visual or audiovisual media, provided that such Content is appropriately designated or marked as NSFW (Not Safe for Work) in accordance with the features and requirements of the Service. The designation of Content as NSFW shall constitute a classification and disclosure mechanism and shall not be construed as creating an exception to, overriding, limiting, or otherwise superseding any prohibition contained within these Terms & Rules or imposed by applicable law. In particular, NSFW designation shall not render permissible any Content involving minors, sexual exploitation of minors, sexual activity involving animals, bestiality, zoophilia, real non-consensual sexual violence, or any other Content expressly prohibited elsewhere in these Terms & Rules. Xerq.cc may further require Content to be appropriately labeled, categorized, restricted, or otherwise presented in a manner reasonably calculated to prevent accidental exposure to users who do not wish to view such material. Sexual or sexually explicit Content communicated solely or primarily in textual form, including written descriptions, discussions, fictional material, commentary, or other text-based expression, shall generally be permitted to the fullest extent allowed by applicable law, unless the particular Content independently violates these Terms & Rules or applicable law, including any Dutch law imposing restrictions upon such material. Nothing contained herein shall be interpreted as requiring Xerq.cc to permit any particular category, format, presentation, or quantity of adult Content, and Xerq.cc retains discretion to establish reasonable classification, visibility, access, moderation, and presentation requirements for such Content in the operation of the Service.
Counterfeit products, unauthorized replicas, and fraudulent goods are prohibited. Users may not use Xerq.cc to advertise, offer for sale, solicit, arrange, broker, distribute, facilitate, or knowingly promote the sale or transfer of counterfeit products, counterfeit merchandise, unauthorized replicas represented as genuine goods, forged branded products, or other goods whose manufacture, labeling, packaging, branding, or representation unlawfully infringes upon the rights of another person, company, trademark owner, copyright holder, or other rights holder. This prohibition includes Content intended to connect prospective purchasers with sellers of such goods, instructions or arrangements for completing prohibited transactions, and attempts to evade applicable intellectual-property, consumer-protection, customs, importation, exportation, or other legal requirements. The prohibition applies whether the transaction is proposed to occur directly through Xerq.cc or through an external website, marketplace, messaging service, payment mechanism, advertisement, hyperlink, or other third-party location where Xerq.cc is knowingly being used to facilitate the prohibited transaction. Nothing in this provision shall prohibit lawful discussion, criticism, comparison, identification, historical examination, news reporting, educational material, consumer warnings, or other legitimate discussion concerning counterfeit goods or replicas, nor shall it prohibit the sale or distribution of genuine products or legitimately manufactured products that do not otherwise violate applicable law or these Terms & Rules.
The unlawful sale, distribution, or facilitation of controlled or illegal substances is prohibited. Users may not use Xerq.cc to advertise, offer, solicit, arrange, broker, facilitate, distribute, sell, purchase, transfer, or knowingly promote transactions involving controlled substances, illegal drugs, or other substances whose possession, manufacture, distribution, sale, or transfer is unlawful under applicable law. This prohibition includes attempts to arrange such transactions through private communications, external websites, third-party marketplaces, payment services, advertisements, hyperlinks, coded references, contact information, or other off-platform mechanisms where the Service is being used as a means of facilitating or promoting the unlawful transaction. Users may not use Xerq.cc to evade applicable drug-control, licensing, prescription, importation, distribution, age, quantity, or other legal restrictions, nor may they knowingly use the Service as an intermediary for connecting purchasers, suppliers, distributors, manufacturers, or other participants in an unlawful transaction. Nothing in this provision shall be interpreted as prohibiting lawful discussion, criticism, education, scientific or academic research, news reporting, historical discussion, harm-prevention information, personal experience, or other lawful exchange of information concerning controlled substances or drugs, provided that the Content does not itself facilitate an unlawful transaction or other prohibited conduct.
Unlawful pharmaceutical sales and transactions are prohibited. Users may not use Xerq.cc to advertise, offer for sale, solicit, arrange, broker, facilitate, or knowingly promote the unlawful sale, distribution, transfer, or procurement of pharmaceuticals, prescription medicines, controlled medicinal substances, or other regulated pharmaceutical products in circumstances where such conduct is prohibited by applicable law. This prohibition includes attempts to circumvent prescription, licensing, dispensing, distribution, importation, exportation, registration, age, quantity, authentication, or other legally applicable requirements, as well as the use of the Service to connect buyers and sellers for transactions that are unlawful in the jurisdiction governing the relevant conduct. The prohibition applies whether the transaction is proposed to occur directly through Xerq.cc or is sought to be arranged through private communications, third-party websites, external marketplaces, payment services, advertisements, hyperlinks, contact information, or other off-platform mechanisms where Xerq.cc is being used as a means of facilitating the unlawful transaction. Nothing in this provision shall be construed as prohibiting lawful discussion, criticism, education, research, personal experience, product information, pharmaceutical reviews, news reporting, or other lawful exchange of information concerning medicines or pharmaceutical products, nor shall it prohibit references to legitimate and lawfully authorized sources for obtaining such products. Xerq.cc may remove Content or take account-level enforcement action where it reasonably determines that Content is being used to facilitate an unlawful pharmaceutical transaction or to evade applicable regulatory requirements.
Malicious software and harmful computer code are prohibited. Users may not upload, distribute, transmit, deploy, knowingly link to for the purpose of distribution, or otherwise use Xerq.cc to facilitate the dissemination of computer viruses, worms, trojans, ransomware, spyware, keyloggers, destructive code, malicious scripts, unauthorized remote-access software, credential-stealing software, or other malware or computer programs designed or reasonably intended to compromise, damage, disrupt, monitor, interfere with, gain unauthorized access to, or otherwise adversely affect a computer system, network, device, account, service, or data. This prohibition includes Content intended to facilitate the creation, deployment, delivery, concealment, persistence, or operational use of such malicious software against an unauthorized target, as well as attempts to distribute malicious files or links through attachments, downloads, external websites, repositories, embedded resources, private communications, or other mechanisms associated with the Service. Legitimate cybersecurity research, malware analysis, reverse engineering, security education, defensive testing, incident reporting, academic discussion, and other lawful technical discussion may be permitted where the purpose and manner of presentation are legitimate and the Content does not materially facilitate unauthorized deployment or malicious use. Xerq.cc reserves the right to remove, quarantine, restrict, disable, or otherwise intervene with respect to Content where reasonably necessary to protect users, systems, infrastructure, accounts, networks, devices, or the security and integrity of the Service.
Unauthorized distribution of copyrighted eBooks and electronic publications is prohibited. Users may not use Xerq.cc to unlawfully sell, distribute, reproduce, upload, transmit, share, offer, solicit, or facilitate access to copyrighted books, eBooks, electronic publications, digital textbooks, or other electronically distributed literary works where the user does not possess the necessary rights, authorization, license, permission, or other lawful basis to make the material available. This prohibition includes unauthorized copies, pirated editions, unlawfully obtained digital files, unauthorized download repositories, and links or instructions whose purpose is to facilitate access to such material where doing so would infringe applicable copyright law. The prohibition applies whether the material is hosted directly on Xerq.cc or made available through an external website, file-hosting service, cloud-storage provider, repository, marketplace, or other third-party location and whether access is offered for payment, barter, exchange, subscription, or without charge. Nothing in this provision shall prohibit lawful discussion, quotation where permitted by applicable copyright law, reviews, criticism, commentary, bibliographic information, educational discussion, references to legitimately authorized editions, or the sharing and distribution of eBooks and electronic publications where the user possesses the necessary rights or authorization to do so. Copyright exceptions and limitations applicable under the governing law shall remain relevant when determining whether a particular use is lawful, and this provision is directed toward unauthorized distribution and facilitation rather than toward the legitimate discussion or lawful possession of electronic publications.
Content concerning terrorism, terrorist organizations, extremist organizations, radical movements, militaristic organizations, or comparable entities shall be evaluated according to its nature, purpose, context, and applicable law. Xerq.cc expressly prohibits the promotion, glorification, endorsement, advocacy, recruitment, material support, fundraising, operational assistance, logistical facilitation, propaganda, or other substantive support of terrorism, terrorist organizations, extremist organizations, or other organizations engaged in or advocating violent, coercive, or unlawful extremist activity. For purposes of these Terms & Rules, the foregoing prohibition expressly includes, without limitation, the following organizations and entities, whether or not a particular entity is characterized or designated identically under the laws of every jurisdiction: Cartel de Sinaloa; Tren de Aragua; Mara Salvatrucha (MS-13); Continuity Irish Republican Army (CIRA); ISIS (formerly al-Qa’ida in Iraq); al-Qa’ida; Boko Haram; Army of Islam; al-Shabaab; Islamic Revolutionary Guard Corps (IRGC); Al-Aqsa Martyrs Brigade; HAMAS; Palestine Liberation Front; Popular Front for the Liberation of Palestine (PFLP); Hizballah; Antifa; and other militaristic, anarchist, or similarly organized enterprises that Xerq.cc determines, in its reasonable discretion, fall within the foregoing prohibition. The inclusion of an organization within this list shall be understood as establishing a prohibition under these Terms & Rules and shall not necessarily constitute a representation that every listed entity possesses an identical formal terrorist designation, legal classification, or status under the domestic law of every country or jurisdiction. The prohibition applies to Content that seeks to advance, legitimize, recruit for, materially assist, finance, organize, operationally support, or otherwise facilitate such organizations or their unlawful activities, including through direct or indirect appeals, propaganda, fundraising requests, recruitment efforts, coded communications, instructions, logistical arrangements, or external resources intended to accomplish substantially the same purpose. Nothing in this provision shall prohibit legitimate discussion, criticism, reporting, historical analysis, academic examination, journalistic coverage, documentary reference, political or social commentary, condemnation, research, or debate concerning terrorism, terrorist organizations, extremist movements, radicalization, or related subjects, provided that the Content does not itself cross into prohibited promotion, glorification, recruitment, material assistance, fundraising, operational support, or other unlawful facilitation. The mere mention, depiction, quotation, criticism, condemnation, historical reference, or discussion of a listed organization shall not, standing alone, be deemed an endorsement or expression of support; however, Content that, by its substance, context, presentation, or apparent purpose, crosses the boundary between legitimate discussion and substantive advocacy or facilitation may be removed, restricted, or otherwise subjected to enforcement action at the discretion of Xerq.cc.
Nothing in these provisions shall be interpreted as requiring Xerq.cc to determine conclusively whether a particular item of Content is protected by fair use, another copyright exception, freedom of expression, freedom of the press, another statutory protection, or any other legal doctrine before taking moderation action. Legal exceptions, defenses, privileges, and limitations are frequently dependent upon specific facts and circumstances, and Xerq.cc may remove, restrict, disable, quarantine, demote, or temporarily limit access to Content where reasonably necessary to comply with applicable law, respond to a legitimate legal complaint, protect the Service or its providers, address a credible risk, preserve the integrity of the platform, or maintain the security and ordinary operation of the community. Conversely, the existence of a copyright claim, complaint, disagreement, demand, objection, governmental inquiry, or assertion by a third party does not automatically establish that Content is unlawful or that its removal is legally required, and Xerq.cc may consider the circumstances, applicable legal protections, and relevant factual context before taking action. Nothing herein shall be construed as a representation that Xerq.cc is obligated to conduct judicially conclusive legal determinations concerning every item of Content prior to moderation, nor shall any moderation decision necessarily constitute an admission concerning the ultimate legality or illegality of the Content in question.
